Terms & Conditions

General

  • All goods and services supplied by Go Calibration Pty Ltd are subject to these Terms and Conditions, which supersede any earlier versions that may appear elsewhere.

  • No order shall be deemed valid unless it has been accepted by the company in form of writing or purchase order.

  • Go Calibration has the absolute discretion to refuse to accept any order from the consumer.

  • Calibration Reports will not be issued until a form of purchase order has been received.

  • You have allowed Go Calibration to add your company name, contact, number and equipment details into our database. Your information remains private and confidential within Go Calibration and its employees.

  • To the extent it is lawful to exclude the following heads of loss and subject to the Buyer’s obligation to pay the price. In no event shall either party be liable for any loss of profits, goodwill, loss of business, loss of data or any other indirect or consequential loss or damage whatsoever.

  • Nothing in this agreement will serve to limit or exclude either parties’ liability for death or personal injury arising from its own negligence.

  • Go Calibration Pty Ltd reserves the right to amend these terms and conditions at any time without notice to the parties.

Payment

  • Terms of payment are strictly net cash with orders unless a credit account has been established with and approved by the company.

  • Where credit account has been established with Go Calibration, payment must be made within 30 days of date of Go Calibration Invoice.

  • Invoices that have not been settled within the given 30 days provided for account holders will incur a 10% late payment fee.

  • Go Calibration reserves the right at its complete discretion to refuse to establish a credit account for any buyer, to refuse credit to any buyer notwithstanding that a credit account may already have been established and to withdraw established credit account facilities.

  • Payment terms may be revoked or amended at Go Calibrations sole discretion.

 

Delivery

  • Calibration Reports will not be issued until a form of   purchase order has been received.

  • Go Calibration shall be entitled to repossess and resell goods delivered to the end user if not paid for in full and for that purpose to enter that property in which they are situated.

  • The buyer acknowledges that the item/s are in working condition and free of any defects and have been made aware of any defects/faulty items by Go Calibration technician/representative.

  • Any time or date quoted by Go Calibration for delivery is intended as an estimate only. Go Calibration shall not be liable to make good any damage or loss whether arising directly or indirectly out of delay of delivery.

  • The risk in the goods and all insurance responsibility for theft, damage or otherwise will pass to the Buyer immediately on the goods being delivered to the Buyer or taken from the Company’s premises.

Service and Repairs

  • If repairs are required outside the provided quotation, Go Calibration reserves the right to charge an additional $80.00 per hour excluding GST, but not without the knowledge and approval of the customer.

  • Any additional items calibrated or serviced by Go Calibration will incur additional charges, but not without the knowledge and approval of the customer.

  • In no event shall, Go Calibration, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with misuse of items purchased from Go Calibration.  

  • Repairs and Services provided by Go Calibration, have limited warranty of three (3) months. The service provider reserves the rights to reject warranty claims, if it is deemed that the item/s have been misused, abusive, lack of proper care of maintenance or whether it has been determined environmental conditions have exceeded those specified by the manufacturer.

 

Warranty and Returns

  • New items purchased from Go Calibration Pty ltd, retain the manufacturers standard warranty from the purchase date, after which all liability of Go Calibration ceases.

  • Any warranty claim must be accompanied by proof of purchase, and full details of the alleged defect.

  • Prior to accepting any warranty claim, Go Calibration is permitted to inspect the defect.

  • Non-Delivery of goods within 7 days of dispatch must be reported immediately to Go Calibration in writing.

  • No goods will be accepted for return unless written permission is provided by Go Calibration Pty Ltd.

  • A return of goods will be accepted only if:

  • The request is made in writing within seven (7) days of delivery accompanied by a copy of the original delivery docket stating Go Calibration Invoice Number and stating the reasons of return.

  • The goods are undamaged and are in resealable and its original packaging.

  • All charges for freight and handling are at the buyer’s expense.

 

Disputes and Privacy

  • In the event a dispute arises out of or in connection with this Agreement, the parties will attempt to resolve the dispute through friendly consultation.

  • If the dispute is not resolved within a reasonable period then any or all outstanding issues may be submitted to mediation in accordance with any statutory rules of mediation. If mediation is unavailable or is not successful in resolving the entire dispute, any outstanding issues will be submitted to final and binding arbitration in accordance with the laws of the State of New South Wales. The arbitrator's award will be final, and judgment may be entered upon it by any court having jurisdiction within the State of New South Wales.

  • In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

  • Confidential information (the “Confidential Information”) refers to any data or information relating to the business of the Customer which would reasonably be considered to be proprietary to the Customer including, but not limited to, accounting records, business processes, and client records and that is not generally known in the industry of the Customer and where the release of that Confidential Information could reasonably be expected to cause harm to the Customer.

  • The Service Provider agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which the Service Provider has obtained, except as authorized by the Customer. This obligation will survive indefinitely upon termination of this Agreement.

 

Force Majeure

Go Calibration is not liable in any way howsoever arising under the terms to the extend that is prevented from acting by events beyond ids reasonable control including, without limitation, industrial disputes, strikes, lockouts, accidents, breakdown, import or export restrictions, acts of God, acts of threats, acts of terrorism or war. If an event of force majeure occurs, Go Calibration may suspense or terminate the terms by written notice to the customer
